TERMS AND CONDITIONS OF LISTING/ ADVERTISING

These terms and conditions ('Terms') apply to all advertising provided by www.businesslistings.com.au  as ABL.

To submit an advertisement/listing with www.businesslistings.com.au 

The Customer must provide accurate information and firstly;

Be the owner of the business or property being listed/advertised or;

Have the authority/ consent of the owner of the property / business being listed/advertised …….

Subject to these Terms, ABL will use its reasonable endeavours to publish online advertising submitted by Customers ('Advertising') in the format submitted by the Customer and in accordance with the information provided by the Customer when submitting an add/listing.

Neither these Terms nor any written or verbal quotation by ABL represent an offer to publish Advertising. A binding contract in relation to a request for Advertising will only be formed between ABL and a Customer when ABL accepts Advertising submitted to www.businesslistings.com.au and acceptance of payment for listing services.

Even if a contract has been formed in accordance with the above clause, ABL reserves the right to refuse or withdraw from publication any Advertising at any time without giving reasons (even if the Advertising has previously been published by ABL).

ABL reserves the right; To vary the placement of Advertising within a particular title and to change the format

ABL will not be liable for any costs, expenses, losses or damages suffered or incurred by a Customer arising from ABL’s failure to publish online Advertising in accordance with a Customer's request.

By submitting Advertising for publication online  the Customer warrants to ABL that the Advertising does not breach or infringe:

The Trade Practices Act (Cth), Fair Trading Acts (State) and equivalent legislation; State and Commonwealth anti-discrimination legislation; Any copyright, trade mark or obligation of confidentiality; Any law of defamation or obscenity; Any law of contempt of any court, tribunal or royal commission; The Privacy Act (Commonwealth); and Any other law (including but not limited to any common law, statute, delegated  legislation, rule and ordinance of the Commonwealth or any State or Territory).

The customer must provide full name and address if requested by ABL for issue of receipt or for legal requirements.

ABL will publish online Listings/Advertising under the heading that it reasonably believes is most appropriate. Advertising headings are for the convenience of readers and are determined at the discretion of ABL.

All advertising information is provided to ABL by the customer in placing a listing/add, ABL reserves the right to correct  typos  and will endeavour to contact the customer if unsure of content before placing the listing /add online

ABL is not liable for any loss, damages or liabilities arising from a failure of the World Wide Web or any telecommunications structure.

The Customer acknowledges that it has not relied on any advice given or representation made by or on behalf of ABL in connection with the Advertising.

The customer  should check their listing at  www.businesslistings.com.,au of Advertising provided to the Customer by ABL; and notify ABL of any errors in the listing/add  published on line. ABL will promptly rectify any problems

If a Customer wishes to make a claim on ABL for credit, re-publication or any other remedy in respect of Advertising, the Customer must send the claim in writing or email  to ABL no later than 30 days after the date of publication of the Advertising online.

It is ABL’s policy to keep the customer satisfied and to make any changes possible to suite customer requirements that are reasonable due to the customer’s own omission in information first provided. Any alterations due to customer’s omission may incur an editing fee of $20 if deemed by ABL to be unreasonable.

ABL limits its liability: for breach of any Non-Excludable Condition (to the extent that liability for such breach can by law be limited); and for any other error or omission in published Advertising caused by ABL to (at ABL’s option) re-supply of the Advertising services affected by the breach, or payment of the cost of re-supply.

The customer must pay for advertising in accordance with the rates in ABL’s www.businesslistings.com.au pricing ( unless otherwise agreed).  Pricing may be varied at any time by ABL without notice; and are inclusive of  GST.

ABL will provide a tax invoice if requested via email

Agents/brokers please note, the Customer's eligibility for discounts and rebates will be based on the Customer's ability to multiple advertise or generate regular advertisers

ABL may grant, deny or withdraw credit to a Customer at any time in its discretion.

The Customer must pay for Advertising: by pre-payment,; cheque or money order

The Customer must pay: the full price for Advertising notwithstanding: the fact that ABL has exercised its right to vary the format or placement of the Advertising; and any error or omission in the Advertising (unless the error or omission was the fault of ABL).  

If a Customer fails to pay for Advertising, ABL may remove the customers add/listings from www.businesslistings.com.au, require cash pre-payment for further Advertising; charge an accounting fee on all overdue amounts and take proceedings against the Customer for any outstanding amounts; Recover from the Customer all costs relating to any action taken by ABL to recover amounts owing for Advertising, Cease publication of any further Advertising on behalf of the Customer and terminate any agreement in relation to Advertising not yet published; and exercise any other rights at law.

ABL reserves the right to withhold any discounts or rebates if the Customer fails to comply with its payment obligations.

ABL excludes all implied conditions and warranties from these Terms, except any condition or warranty such as conditions and warranties implied by the Trade Practices Act and equivalent State acts

ABL excludes all other liability to the Customer for any costs, expenses, losses and damages suffered or incurred by the Customer in connection with these Terms, whether that liability arises in contract, tort (including by ABL’s negligence) or under statute. Without limitation, ABL will in no circumstances be liable for any indirect or consequential losses, including loss of profits, loss of revenue and loss of business opportunity.

The Customer indemnifies ABL and its officers, employees, contractors and agents (the 'Indemnified') against any costs, expenses, losses, damages and liability suffered or incurred by the Indemnified arising from the Customer's breach of these Terms and any negligent or unlawful act or omission of the Customer in connection with the Advertising.

Privacy: ABL collects a Customer's personal information to provide the Advertising services to the Customer and for invoicing purposes. ABL may disclose this personal information to credit reporting agencies and other third parties as part of provision of the Advertising. Where a Customer has an overdue account, ABL may disclose personal information to debt collection agencies to recover the amount due.

Customers may gain access to their personal information by emailing ABL These Terms represent the entire agreement of the Customer and ABL in relation to listing/ Advertising and cannot be varied except in writing by an authorised officer of ABL.

ABL will not be liable for any delay or failure to publish Advertising caused by a factor outside ABL's reasonable control (including but not limited to any Act of God, war, breakdown of plant, industrial dispute, electricity failure, governmental or legal restraint).

These Terms are governed by the laws of the state of  Victoria, in relation to Advertising published  online with www.businesslistings.com.au.
